Terms of service

These Terms of Service (“Terms”) govern the use of mushyspetcare.com and purchases, bookings, and services provided by Mushy’s Pet Care LLC (“Mushy’s,” “we,” “us,” or “our”).

By purchasing a product, booking a service, submitting payment for a reservation, or otherwise using services provided by Mushy’s, you agree to these Terms and any additional written terms applicable to your specific booking.

1. Services

Mushy’s may provide services including:

  • Dog boarding
  • Dog daycare
  • Dog training
  • Dog celebrations and birthdays
  • Pet photoshoots
  • Social or special pet experiences
  • Pet merchandise
  • Other related pet-care or lifestyle services

Availability, eligibility, pricing, and service details may change.

2. Owner Authorization

The person booking services represents that they are the pet’s owner or otherwise have authority to place the pet in Mushy’s care and make decisions concerning the pet as necessary for the booked service.

3. Accurate Information and Disclosure

The customer agrees to provide accurate, current, and complete information about the pet.

Before care begins, customers must disclose information reasonably relevant to safe care, including known:

  • Medical conditions
  • Allergies
  • Medications
  • Dietary restrictions
  • Injuries
  • Infectious or potentially contagious conditions
  • Behavioral concerns
  • Aggression
  • Bite history
  • Resource guarding
  • Escape tendencies
  • Separation anxiety
  • Reactivity
  • Special handling requirements

Mushy’s relies upon information supplied by the customer.

Failure to disclose material health or behavioral information may result in refusal, modification, or termination of services.

4. Health and Vaccination Requirements

Pets must satisfy health and vaccination requirements communicated by Mushy’s and applicable legal requirements.

Mushy’s may request vaccination or veterinary documentation before accepting a pet.

Customers agree not to knowingly bring an animal exhibiting a contagious illness or condition into care without first disclosing it.

Mushy’s may decline or separate a pet if we reasonably believe the pet’s condition could endanger that pet, another animal, or a person.

5. Fleas, Parasites and Communicable Conditions

Customers should ensure pets are appropriately protected against fleas, ticks, parasites, and communicable diseases in consultation with their veterinarian.

If parasites or a potentially communicable condition are discovered while a pet is in our care, Mushy’s may take reasonable steps to isolate the pet and contact the owner.

Necessary additional care or veterinary expenses may be charged to the owner where appropriate and permitted by law.

6. Temperament and Behavior

Mushy’s may evaluate whether a dog is suitable for a particular service or environment.

Acceptance of a dog on one occasion does not guarantee future acceptance.

Mushy’s may modify or discontinue group interaction or services when reasonably necessary to protect people or animals.

7. Dog-to-Dog Interaction and Normal Risks

Depending upon the service, dogs may participate in indoor or outdoor activities, walks, play, supervised interaction, and other ordinary pet-care activities.

Customers acknowledge that interaction between animals and ordinary pet activities involve inherent risks even with reasonable supervision. These may include minor scratches, bites, falls, muscle soreness, damaged nails, accidental injury, escape attempts, ingestion of foreign objects, allergic reactions, or exposure to communicable conditions.

This acknowledgment does not waive rights or responsibilities that cannot lawfully be waived and does not excuse Mushy’s from duties imposed by applicable law.

8. Standard of Care

Mushy’s will provide care consistent with applicable law and the agreed service.

Washington law’s definition of minimum animal care includes appropriate food, potable water, shelter and veterinary or other care reasonably necessary to prevent or timely relieve distress from injury or physical infirmity. 

Nothing in these Terms is intended to reduce any mandatory standard of animal care.

9. Emergency Veterinary Authorization

If Mushy’s reasonably believes a pet requires urgent veterinary attention, we will make reasonable efforts to contact the owner and/or designated emergency contact.

If timely contact cannot be made and delaying treatment could reasonably threaten the animal’s health or welfare, the customer authorizes Mushy’s to seek reasonably necessary veterinary evaluation or emergency treatment.

Whenever reasonably practicable, Mushy’s will use the pet’s designated veterinarian. In an emergency, another reasonably available veterinary provider may be used.

The customer remains financially responsible for veterinary services, transportation, medication, and related expenses attributable to their pet except to the extent another allocation of responsibility is required by applicable law.

Mushy’s does not guarantee the availability or outcome of veterinary treatment.

10. Medications

Customers must provide clear written instructions for medications or special care.

Medication should be supplied in appropriately labeled/original packaging whenever reasonably possible.

Mushy’s may decline to administer medications or provide medical procedures beyond the reasonable scope of our services.

Mushy’s is not a veterinary clinic and our services are not veterinary medical services.

11. Food

Customers should provide sufficient food and accurate feeding instructions for the scheduled stay unless another arrangement has been made.

Mushy’s may use reasonable substitute food when necessary to provide appropriate care if supplied food becomes unavailable, subject to known allergies and dietary restrictions communicated by the owner.

12. Personal Property

Customers may provide collars, harnesses, leashes, bedding, toys, bowls, crates, or other belongings when permitted.

Normal use around animals can result in damage or loss.

Mushy’s is not responsible for ordinary wear, chewing, soiling, or accidental damage to pet belongings except where responsibility is imposed by applicable law.

Customers should not leave irreplaceable or unusually valuable items with their pet.

13. Drop-Off and Pickup

Customers are responsible for following agreed drop-off and pickup arrangements.

Additional charges may apply when a pet remains in care beyond the reserved period.

Where a late pickup results in an additional daycare period or boarding night, the applicable additional service charge may be assessed.

14. Extensions

Extending a boarding or daycare reservation requires approval and is subject to availability.

Customers are responsible for charges associated with approved extensions.

15. Failure to Collect a Pet

Customers must collect pets at the end of their scheduled reservation.

If a pet is not collected, Mushy’s will make reasonable efforts to contact the owner and emergency contacts.

Continuing boarding/care charges may accrue while the pet remains in our care.

Mushy’s will handle an apparently abandoned animal in accordance with applicable Washington law rather than treating ownership as automatically transferred merely because a pickup was missed.

Washington law contains specific provisions concerning when an animal left for board or care is deemed abandoned, including rules concerning specified and unspecified custody periods. 

16. Payment

Customers agree to pay applicable charges disclosed for their booking or purchase.

Mushy’s may require deposits, advance payment, or full payment to reserve services.

Additional authorized services, extensions, late pickup, veterinary expenses, special-care requirements, or other agreed charges may result in additional amounts due.

17. Pricing and Taxes

Prices may change prospectively.

The price applicable to a confirmed transaction will generally be the price agreed or displayed when that transaction was completed, subject to correction of obvious errors where permitted by law.

Applicable taxes will be collected where required.

Washington Department of Revenue currently identifies sales of pet supplies as subject to Retailing B&O and sales tax, while its dog-industry guidance identifies dog training, boarding and walking as Service and Other Activities B&O activities for which retail sales tax does not apply. 

18. Cancellations and Refunds

Cancellations, refunds, returns, early pickups, no-shows, holiday bookings, and related matters are governed by our Refund Policy, which is incorporated into these Terms.

19. Photographs and Video

Mushy’s may photograph or record pets for owner updates, service documentation, safety, or operational purposes.

Customers may request that their pet not appear in public promotional or social-media content by notifying Mushy’s in writing.

Nothing in these Terms grants Mushy’s ownership of customer-supplied copyrighted photographs or other customer content beyond permissions reasonably necessary to provide the requested service.

20. Photoshoots and Celebrations

Photoshoots, birthdays, themed events, and customized experiences may involve advance planning and specially purchased materials.

Exact decorations, props, colors, layouts, photographs, or creative results may vary based on availability, lighting, animal behavior, safety, weather, and other circumstances.

We will not force an animal to participate in an activity that we reasonably believe would compromise its welfare or safety.

21. Product Purchases

Product photographs and descriptions are intended to represent merchandise as accurately as reasonably possible.

Actual colors, patterns, sizing, positioning, and appearance may vary due to manufacturing variations, screens, photography, and individual pets.

Customers are responsible for reviewing available sizing information before purchasing.

22. Pet Product Safety

Customers are responsible for selecting products appropriate for their pet and supervising their pet where appropriate.

Pet toys and accessories are not necessarily indestructible.

Discontinue use of a product if it becomes damaged or presents a potential hazard.

Information provided by Mushy’s concerning pet products or care is general information and is not a substitute for professional veterinary advice.

23. Shipping

Physical merchandise is subject to our Shipping Policy, which is incorporated into these Terms.

24. Website Use

You agree not to:

  • Use this website unlawfully
  • Attempt unauthorized access to the website or systems
  • Introduce malicious code
  • Interfere with website operation
  • Commit fraud or submit intentionally false information
  • Copy or exploit protected Mushy’s content in violation of applicable intellectual-property law

25. Intellectual Property

Unless otherwise indicated, Mushy’s branding, original website content, logos, graphics, photographs, videos, designs, written materials, and other original materials are owned by or licensed to Mushy’s Pet Care LLC and are protected to the extent provided by applicable law.

Nothing on this website grants a license to commercially reproduce Mushy’s protected materials without authorization.

26. Third-Party Services

Our website and operations may rely upon third parties including Shopify, payment processors, shipping carriers, social-media platforms, mapping providers, or other service providers.

Those providers may maintain their own terms and privacy practices.

27. Disclaimer

Mushy’s strives to provide high-quality services and accurate website information.

Except for warranties or obligations that cannot lawfully be excluded, products, website content, and services are subject to the terms expressly provided in connection with them.

Nothing on the website constitutes veterinary, medical, legal, or other licensed professional advice.

28. Limitation of Liability

To the fullest extent permitted by applicable law, Mushy’s will not be liable for indirect, incidental, special, exemplary, or consequential damages arising solely from circumstances for which applicable law permits liability to be limited.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

29. Customer Responsibility and Indemnification

To the extent permitted by law, customers are responsible for losses or claims arising from their material breach of these Terms, intentionally or materially inaccurate information supplied regarding their pet, or conduct for which they are legally responsible.

Nothing in this provision requires a customer to indemnify Mushy’s for liability that applicable law places upon Mushy’s.

30. Force Majeure

Mushy’s will not be responsible for delay or inability to perform caused by circumstances reasonably beyond our control, subject to rights that cannot be waived.

Such circumstances may include severe weather, wildfire, natural disaster, government action, utility failure, transportation interruption, widespread illness, or emergency conditions.

Where possible, we will communicate with affected customers and determine reasonable alternatives.

31. Privacy

Our collection and handling of personal information is described in our Privacy Policy.

32. Changes

Mushy’s may revise these Terms prospectively.

The current version will be displayed on our website with an updated date.

Changes will not retroactively eliminate rights that have already accrued where prohibited by law.

33. Severability

If a provision of these Terms is determined to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

34. No Waiver

Failure to enforce a provision on one occasion does not necessarily waive the right to enforce it later.

35. Governing Law

These Terms are governed by applicable federal law and the laws of the State of Washington, without eliminating mandatory rights available under applicable consumer-protection or other laws.
